IN NO EVENT SHALL DEWEY'S PIZZA'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO DEWEY'S PIZZA IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

These limitations apply regardless of the legal theory on which the claim is based, whether in contract, tort (including negligence), strict liability, or otherwise, and even if Dewey's Pizza has been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations of liability; in such cases, our liability shall be limited to the maximum extent permitted by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Dewey's Pizza, its owners, officers, directors, employees, agents, subcontractors, licensors, and successors (collectively, "Indemnified Parties") from and against any and all claims, damages, losses, costs, liabilities, judgments, and expenses (including reasonable attorneys' fees and court costs) arising out of or in connection with:

YOU AND DEWEY'S PIZZA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims of more than one person, preside over any class or representative proceeding, or award class-wide relief.

15.4 Small Claims Court

Notwithstanding the above, either party may bring an individual claim in a small claims court of competent jurisdiction, provided the claim qualifies and remains in such court.

15.5 Opt-Out Right

You may opt out of the binding arbitration agreement within thirty (30) days of first accepting these Terms by sending a written notice to [email protected] with the subject line "Arbitration Opt-Out." Your opt-out will not affect any other provision of these Terms.

16. Term and Termination

These Terms are effective from the date you first access the Website or use the Services and shall remain in full force and effect for as long as you continue to use the Services, unless earlier terminated as provided herein.

Dewey's Pizza reserves the right, in its sole discretion and without prior notice, to:
